Title of Goods Ownership Clause: Title of goods remain property of All I.T. Solutions (QLD) until PAID IN FULL.

1.1 Ownership Retention: Title to all goods, whether physical or digital, supplied by All I.T. Solutions (QLD) shall remain the property of All I.T. Solutions (QLD) until payment is received in full.

1.2 Unpaid Debts for Digital and Physical Products: In the event of non-payment for physical and/or digital/virtual products, including downloaded software programs and licenses, with a debt outstanding for a period exceeding 60 days, you hereby grant All I.T. Solutions (QLD) the right to employ reasonable tools and resources to recover the unpaid debt.

1.3 Recovery Measures: To recover the outstanding debt, you agree to allow All I.T. Solutions (QLD) to utilize reasonable means, including but not limited to accessing addresses registered to you and locations where physical products are stored for the purpose of collection.

1.4 Compliance with Australian Law: This clause is subject to and in compliance with applicable Australian laws and regulations. In the event of any conflict between this clause and Australian law, the latter shall prevail.

 

Warranty for New Hardware and Components: All NEW hardware and/or NEW components are covered by a 12 month manufacturers warranty from the date of invoice unless otherwise stated

2.1 Manufacturer’s Warranty Period: All new hardware and/or new components supplied by All I.T. Solutions (QLD) are covered by a 12-month manufacturer’s warranty starting from the date of the invoice, unless explicitly stated otherwise.

2.2 Scope of Warranty: During the warranty period, All I.T. Solutions (QLD) will, at its discretion, repair or replace any new hardware or components found to be defective due to faulty materials or workmanship.

2.3 Exclusions: This warranty does not cover damages caused by misuse, accidents, unauthorized modifications, or any other factors not arising from normal use.

2.4 Claims Process: To make a warranty claim, please notify All I.T. Solutions (QLD) promptly. Proof of purchase and details of the issue may be required.

2.5 Manufacturer’s Terms: The terms of the manufacturer’s warranty are applicable, and any claims made under this warranty are subject to the conditions specified by the manufacturer.

2.6 Australian Consumer Law: This warranty is provided in addition to any rights you may have under the Australian Consumer Law, and nothing in this clause limits those rights.

 

Warranty for NEW Hardware and Components: All warranties are for NEW hardware and/or components only for repair or replacement by “the manufacturer/supplier”.

3.1 Manufacturer’s Warranty Coverage: All warranties provided by All I.T. Solutions (QLD) for new hardware and/or new components are applicable for a period of 12 months from the date of the invoice, unless explicitly stated otherwise.

3.2 Repair or Replacement by Manufacturer/Supplier: Warranties cover repair or replacement of new hardware and/or components, and such services will be facilitated by the manufacturer/supplier responsible for the product.

3.3 Scope of Warranty: During the warranty period, All I.T. Solutions (QLD) will not provide direct repair or replacement services but will assist customers in coordinating with the relevant manufacturer/supplier as necessary.

3.4 Exclusions: This warranty does not cover damages caused by misuse, accidents, unauthorized modifications, or any other factors not arising from normal use.

3.5 Claims Process: To initiate a warranty claim, please notify All I.T. Solutions (QLD) promptly. Assistance will be provided in facilitating communication with the manufacturer/supplier. Proof of purchase and details of the issue may be required.

3.6 Manufacturer’s Terms: The terms and conditions of the manufacturer’s warranty prevail, and any claims made under this warranty are subject to the conditions specified by the manufacturer/supplier.

3.7 Australian Consumer Law: This warranty is provided in addition to any rights you may have under the Australian Consumer Law, and nothing in this clause limits those rights.

 

Nil Stock or Discontinued Items: Items that are nil stock and/or discontinued, a equivalent value item is offered.

4.1 Product Availability: In the event that a product becomes nil stock or is discontinued, All I.T. Solutions (QLD) reserves the right to offer an alternative item of equivalent value.

4.2 Equivalent Value Determination: The determination of equivalent value will be made at the discretion of All I.T. Solutions (QLD) based on comparable features, specifications, and market value.

4.3 Notification: Customers will be promptly notified of the unavailability or discontinuation of the ordered product. In such cases, All I.T. Solutions (QLD) will provide details of the proposed alternative item.

4.4 Customer Agreement: By proceeding with the purchase, you agree to accept the offered alternative item of equivalent value in lieu of the originally ordered product.

4.5 Communication: All communications regarding nil stock, discontinued items, or alternative offerings will be conveyed via the contact information provided during the purchase process.

4.6 Australian Consumer Law: This clause is subject to and complies with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.

 

Software and Data Loss Exclusion: Software and data loss is NOT covered by our warranty.

5.1 Limitation of Warranty: All I.T. Solutions (QLD) expressly excludes coverage for software-related issues and data loss under its warranty.

5.2 Software Issues: The warranty provided by All I.T. Solutions (QLD) does not extend to cover problems or malfunctions arising from software-related issues, including but not limited to installation, configuration, compatibility, or user errors.

5.3 Data Loss: The warranty does not cover any loss or corruption of data, including but not limited to data stored on hardware components or systems.

5.4 User Responsibilities: It is the responsibility of the user to regularly back up data and ensure the proper functioning and security of software applications.

5.5 Professional Services: All I.T. Solutions (QLD) may offer separate professional services for software-related assistance, and any such services will be subject to separate terms and conditions.

5.6 No Liability for Loss: All I.T. Solutions (QLD) shall not be liable for any direct or indirect loss of data or software-related issues, regardless of the cause.

5.7 Australian Consumer Law: This clause is in compliance with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.

 

Warranty Return Policy: All warranties are Return To Base unless otherwise stated

6.1 Return to Base Warranty: All warranties provided by All I.T. Solutions (QLD) are designated as Return To Base (RTB), unless explicitly stated otherwise.

6.2 Definition of Return To Base (RTB): Under RTB warranty, customers are responsible for returning the faulty product to the designated location specified by All I.T. Solutions (QLD) for inspection and repair.

6.3 Shipping Costs: The customer is responsible for any shipping costs associated with returning the product to the designated location for warranty service.

6.4 Exceptional Cases: In cases where an alternative warranty arrangement is explicitly stated for specific products, the terms and conditions of that arrangement shall prevail.

6.5 Notification Process: Customers must notify All I.T. Solutions (QLD) of any warranty claims and follow the prescribed RTB process provided by All I.T. Solutions (QLD).

6.6 Repair or Replacement: Upon receiving the returned product, All I.T. Solutions (QLD) will, at its discretion, repair or replace the faulty item in accordance with the terms of the warranty.

6.7 Australian Consumer Law: This clause is subject to and complies with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.

 

Card Payment Surcharge: Card Payments incur a surcharge which is not refundable

7.1 Surcharge Imposition: All card payments made to All I.T. Solutions (QLD) will incur a surcharge. The surcharge percentage will be clearly communicated to customers at the time of the transaction.

7.2 Non-Refundable Surcharge: The surcharge applied to card payments is non-refundable under any circumstances. This includes, but is not limited to, refunds for returned products, cancellations, or other instances where a refund may be applicable.

7.3 Communication of Surcharge: Customers will be informed of the applicable surcharge percentage at the point of sale, and this information will be clearly displayed in relevant transaction documents.

7.4 Acceptance of Surcharge: By proceeding with a card payment, the customer acknowledges and accepts the surcharge applied by All I.T. Solutions (QLD).

7.5 Updates to Surcharge Percentage: All I.T. Solutions (QLD) reserves the right to update the surcharge percentage, and any changes will be communicated to customers in advance.

7.6 Australian Consumer Law: This clause is in compliance with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.

 

Invoice Presentation for Warranty Claims: This invoice must be presented for all warranty claims

8.1 Proof of Purchase Requirement: For all warranty claims, customers are required to present the original invoice issued by All I.T. Solutions (QLD) as proof of purchase.

8.2 Invoice Details: The invoice must contain relevant details, including but not limited to the date of purchase, product descriptions, and the total amount paid.

8.3 Warranty Claim Submission: Customers must submit the original invoice along with the warranty claim, providing a clear reference to the product in question.

8.4 Verification Process: All I.T. Solutions (QLD) reserves the right to verify the authenticity of the invoice and may request additional information to process the warranty claim.

8.5 No Warranty Without Invoice: Warranty claims will not be processed in the absence of a valid and original invoice.

8.6 Retention of Invoice: It is the responsibility of the customer to retain and safeguard the original invoice for the duration of the warranty period.

8.7 Australian Consumer Law: This clause is in compliance with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.

 

Minimum Surcharge for Wrongful Claims: A minimum surcharge will apply for any wrongful claims

9.1 Wrongful Claim Surcharge: A minimum surcharge will apply in the event of any wrongful or unsubstantiated claims made by the customer.

9.2 Definition of Wrongful Claims: Wrongful claims include, but are not limited to, claims for warranty service when no fault is found, false reports of product defects, or claims made with the intent to deceive.

9.3 Surcharge Amount: The minimum surcharge amount will be determined at the discretion of All I.T. Solutions (QLD) and will be communicated to the customer in writing.

9.4 Communication of Surcharge: Customers will be informed of the potential surcharge for wrongful claims at the time of purchase and in any relevant documentation.

9.5 Acceptance of Surcharge: By engaging in a transaction with All I.T. Solutions (QLD), the customer acknowledges and accepts the potential surcharge for wrongful claims.

9.6 Review of Wrongful Claims: All I.T. Solutions (QLD) reserves the right to review and assess the validity of any claims before applying a surcharge.

9.7 Australian Consumer Law: This clause is in compliance with the Australian Consumer Law, and nothing in this clause limits the rights and remedies available under the law.
